Introduction
This website is operated by Barnstormer UAV Solutions Inc. The terms “we”, “us”, and “our” refer to Barnstormer UAV Solutions Inc. The use of our website is subject to the following terms and conditions of use, as amended from time to time (the “Terms”). The Terms are to be read together by you with any terms, conditions or disclaimers provided in the pages of our website. Please review the Terms carefully. The Terms apply to all users of our website, including without limitation, users who are browsers, customers, merchants, vendors and/or contributors of content. If you access and use this website, you accept and agree to be bound by and comply with the Terms and our Privacy Policy. If you do not agree to the Terms or our Privacy Policy, you are not authorized to access our website, use any of our website’s services or place an order on our website.
Use of our Website
You agree to use our website for legitimate purposes and not for any illegal or unauthorized purpose, including without limitation, in violation of any intellectual property or privacy law. By agreeing to the Terms, you represent and warrant that you are at least the age of majority in your state or province of residence and are legally capable of entering into a binding contract. You agree to not use our website to conduct any activity that would constitute a civil or criminal offence or violate any law. You agree not to attempt to interfere with our website’s network or security features or to gain unauthorized access to our systems. You agree to provide us with accurate personal information, such as your email address, mailing address and other contact details in order to complete your order or contact you as needed. You agree to promptly update your account and information. You authorize us to collect and use this information to contact you in accordance with our Privacy Policy.
Description of Services
1. Provision of consulting services related to, but not limited to UAV program development, design, management, pilot review and other related activities.
2. Provision of digital access to RTK/VRS data through GEODNET based on a pre-paid time limited subscription.
All purchases through our website are subject to product availability. We may, in our sole discretion, limit or cancel the quantities offered on our website or limit the sales of our products or services to any person, household, geographic region or jurisdiction. Prices for our products are subject to change, without notice. Unless otherwise indicated, prices displayed on our website are quoted in Canadian dollars (CAD). We reserve the right, in our sole discretion, to refuse orders, including without limitation, orders that appear to be placed by distributors or re-sellers. If we believe that you have made a false or fraudulent order, we will be entitled to cancel the order and inform the relevant authorities.
Refund/Cancellation
Due to the nature of flight training and advanced pilot certificate review pursuant to Transport Canada guidelines/requirements all payments must be received prior to the examination being completed. There are no refunds. All reasonable efforts will be made to accommodate review pending client’s completion/submission of documentation to allow a review to proceed and dependent on weather conditions favorable to completing the actual flight portions of training and review. Cancellations of flight training or reviews may be charged a minimum of the facility rental costs and up to 50% of the overall costs depending on circumstances of the cancellation. Every effort will be made to reschedule versus cancel training/review.
Due to the nature of the delivery (digital) of the access to the RTK/VRS data through GEODNET all payments must be received in full before access is granted and no refunds or cancellations are possible.
Shipping
Shipping Methods- will depend on the product which is being purchased, where it will be delivered and the timeframe afforded by the project design. All details will be discussed with the client at the time of invoice finalization.
Expected Timeframes – will depend on the nature of the project. For RTK/VRS data access through GEODNET it is expected that the data requested should be available within 2 working days of the original confirmation of final payment.
Shipping Prices – will depend on the product which is being purchased, where it will be delivered and the timeframe afforded by the project design. All details will be discussed with the client at the time of invoice finalization.
Shipping Restrictions – Barnstormer UAV Inc. will observe any shipping/distribution restrictions as dictated by the Government of Canada.
International Shipping – At this time international shipping will be restricted to digital products with purchaser being responsible for any or all taxes that should be levied in their jurisdiction. (See below).
Customs, Duties and Taxes – all costs associated with Customs, Duties and Taxes ultimately remain the responsibility of the purchaser. Barnstormer UAV Solutions Inc. will collect required Canadian Federal and Provincial/Territorial taxes as required provided we are aware of the client’s location.
Contact Details for Missing or Lost Packages – Contact Barnstormer UAV Solutions Inc. directly for details relating to missing or lost packages.
Other (Age restrictions, ID requirements etc.) – clients purchasing UAV related or RTK/VRS services are required to provide a proper contact/billing address, email and/or phone number to allow for processing of payments through Barnstormer UAV Solutions e-commerce provider.
Force Majeure
Barnstormer UAV Solutions Inc. shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.
Limitation of Liability
The Client acknowledges and agrees that Barnstormer UAV Solutions Inc. will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.
Indemnification
You agree to defend and indemnify us, and hold us and our affiliates harmless, and our and their respective directors, officers, agents, contractors, and employees against any losses, liabilities, claims, expenses (including legal fees) in any way arising from, related to or in connection with your use of our website or products purchased through it.
No Guarantee
The client acknowledges and agrees that Barnstormer UAV Solutions Inc. cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.
General Conditions
We reserve the right to refuse service to anyone, at any time, for any reason. We reserve the right to make any modifications to the website, including terminating, changing, suspending or discontinuing any aspect of the website at any time, without notice. We may impose additional rules or limits on the use of our website. You agree to review the Terms regularly and your continued access or use of our website will mean that you agree to any changes. You agree that we will not be liable to you or any third party for any modification, suspension or discontinuance of our website or for any service, content, feature or product offered through our website.
